PETRA JAYA: The Sarawak state legislative assembly on Tuesday unanimously voiced its approval to setting up a negotiation committee to discuss the Malaysia Agreement 1963 (MA63).

The proposal was mooted by Sarawak Tourism, Arts, Culture, Youth and Sports Minister Datuk Abdul Karim Rahman Hamzah and was approved after being debated upon by 31 members of the state assembly, including representatives from Pakatan Harapan (PH).

The committee will be chaired by state assembly Speaker Datuk Amar Mohd Asfia Awang Nassar.

Abdul Karim has also been included in the committee, which also feature state International Trade and E-Commerce Minister and Second Finance Minister Datuk Seri Wong Soon Koh; Sharifah Hasidah Sayeed Aman Ghazali, who is Junior Minister in the Chief Minister’s Office (Law, State-Federal Relations and Project Monitoring); as well as Junior Minister in the Chief Minister’s Office (Corporate Affairs) Abdullah Saidol.

Also included are state Youth and Sports Junior Minister Datuk Snowdan Lawan; Muara Tuang state assemblyman Datuk Idris Buang; Piasau assemblyman Datuk Sebastian Ting; and Tasik Biru assemblyman Datuk Henry Harry Jinep.

Two PH representatives are also in the committee - Batu Lintang assemblyman See Chee How and Bukit Assek assemblyman Irene Chang.

State assembly opposition leader Chong Chieng Jen, while debating the motion, had also suggested for the addition of three more names (two from PH), which were Tanjung Batu assemblyman Chiew Chiu Sing; Krian assemblyman Ali Biju; and Deputy Speaker Datuk Gerawat Gala.

Abdul Karim, in tabling the motion, said the committee was set up to fight for the interests, rights and position of Sarawak as enshrined in MA63 and the Federal Constitution.

“In addition, the committee is also meant to fulfil the wishes of the people of Sarawak for greater autonomy and for the devolution of power to the state.

“The committee’s establishment is in line with Standing Order 89 and Article 24(1) of the State Constitution, with its composition made up the state assembly members,” he said.

Abdul Karim said the committee was also set up because the MA63 Steering Committee at Federal-level only had two representatives for Sarawak.

“On September 5, 2018, the Federal Cabinet had decided that the MA63 Steering Committee would be chaired by the prime minister and composed of representatives of the Federal government as well as those from Sabah and Sarawak to study the implementation of MA63.

“However, Sarawak is only being represented by Chief Minister Datuk Patinggi Abang Johari Abang Openg as well as Works Minister Baru Bian.

Sabah govt to push for transfer of powers from Fed govt

KOTA KINABALU: The Sabah government will push for transfer of powers from federal in the aspects of administration, monitoring and distribution of tasks at the state level.

Chief Minister Datuk Seri Mohd Shafie Apdal said the state would submit a proposal to the Federal government on the devolution of powers especially when Sabah has established new ministries such as Innovation and Education Ministry; and Health and People’s Wellbeing Ministry.

He noted education and health were under the jurisdiction of federal government as stipulated in the Federal Constitution.

“The state government will ensure the federal and state agencies’ functions will not overlap such as Public Works Development (PWD) and the tourism,” he said at the 15th state assembly sitting here, today.

“The state government is making efforts to tackle the many overlapping functions and roles in several federal and state agencies to ensure a more efficient, systematic and effective management and human resource development in the state public services,” he said in replying to a question on devolution of powers by Datuk Bolkiah Ismail (Independant-Pitas).

In responding further to a supplementary question by Datuk Seri Hajiji Noor (GBS-Sulaman) on executive power, Shafie said he would continue to negotiate with the federal government and noted it would take time to ensure agreement is met.

He said whatever projects from the federal government should be coordinated by the state to ensure that the people would benefit from the development.

Citing the upgrading works for 30 schools under federal’s Works Department, he said the projects had been abandoned while the ones managed by state’s PWD were carried out smoothly.

Replying to additional question on state’s power on immigration Datuk Limus Jury (Upko-Kuala Penyu), Shafie assured the government’s power would remain but stressed that the state needed to have proper system in place.

“We will fine-tune this. There’s no use of having power without proper system. So, it’s time for us to ensure we have a proper system and structure to implement it,” he said.

On MA63 raised by Limus earlier, Shafie said the state government would bring up matter with regards to the list structure of states in Malaysia so it would return to its original arrangement as equal partners as provided under MA63.

“In the Nov 1 meeting by Pre-Cabinet Special Committee to review MA63, it has been agreed that the state government be tabled proposal to amend Article 1 (2) of the Federal Constitution (for Name, States and territories of the Federation) in the first Special Cabinet Meeting,” he said.

Responding to additional questions on MA63 by Datuk Jahid Jahim (GBS-Tamparuli) and and Datuk Dr Jeffery Kitingan (GBS-Tambunan), Shafie said he welcomed recommendations from all quarters, including to opposition, and would review them prior to tabling the proposal.

Time to allow Sabah to manage its own oil and gas, says law minister

KOTA KINABALU: De facto law minister Liew Vui Keong believes the Petroleum Development Act (PDA) 1974 that created Petronas and allowed it to exploit oil and gas wealth in the federation must be reviewed and amended.

In a speech at a “Dinner with the Minister” function here tonight, Liew said the time had come for the Sabah government to take the proper steps to manage its own oil and gas resources more effectively.

“Amending the Act would give the Sabah government more advantages in managing its own oil and gas.

“This is in line with the intention of the Pakatan Harapan government and Warisan to give equal rights to Sabah, as announced by Prime Minister Dr Mahathir Mohamad last Malaysia Day,” he said.

Liew also supported the amendment to Section 4 of the Land Ordinance, passed by the Sabah assembly yesterday, which refined the interpretation of land in Sabah.

The Land Ordinance (Cap 68) is amended in Section 4, in the definition of land to include the bed of any river, stream, lake or water course, with the area of the continental shelf being the seabed and its subsoil, which lies beneath the high seas, contiguous to the territorial waters of Sabah, as stated in the North Borneo (Alteration of Boundaries) Order in Council 1954.

The amendment allows the Sabah government to claim its rights on all natural resources in lakes, rivers and seabed in its Continental Shelf and, indirectly, strengthens Sabah’s claims for its rights under the Malaysia Agreement 1963 (MA63).

“This amendment to the Land Ordinance by the Sabah government is a holistic action in its effort to reclaim its rights on the sales tax on all minerals extracted in Sabah.

“The implication of this amendment will enable the federal government to be prepared to review or make appropriate amendments to any of the provisions of the law involved in the Petroleum Development Act 1974 and the Federal Constitution in general,” he said.

Under the MA63, Sabah’s boundaries have been set by the North Borneo (Alteration of Borders) Order in Council 1954, which some argued was more powerful when used in international law compared with the more local Land Ordinance.

The Sabah (then North Borneo) Order in Council extended the boundaries of the then Colony of North Borneo to “include the area of the continental shelf being the seabed and its subsoil which lies beneath the high seas contiguous to the territorial waters of North Borneo”.

In terms of oil and gas, prior to 1974, Sabah had already started production of crude oil with then Sabah chief minister, the late Mustapha Harun signing six international oil agreements in 1969 with international oil companies to explore and mine the oil with Sabah to receive, among others, royalties of 12.5% of the oil concessions.

Under the PDA, Sabah receives only 5% profit based on gross production.

The Pakatan Harapan government, under the leadership of Prime Minister Dr Mahathir Mohamad, has said it would consider giving 20% royalty to Sabah but the value will be calculated based on net profit and not gross production.

砂政府自行运作学前教育 沈桂贤：预备取回教育自主权

（古晋21日讯）砂地方政府与房屋部长拿督沈桂贤表示，砂政府将持续支持本地华文教育的发展，而首长拿督巴丁宜阿邦佐哈里也已承诺，除了将拨土地让华教以地养校之外，日后也将继续拨款予独中。

他说，透过石油税的税务征收，砂拉越将逐渐在经济上独立，日后所拥有的资金将用于改善本地各领域的发展，照顾砂拉越人的福利。

他举例，如今砂政府也开始自行运作州内的儿童学前教育，这也是为了预备有朝一日从联邦政府手中得到教育自主权后，砂政府已于教育领域中有一定的运作基础。

Sarawak snubs law minister’s MA63 review committee, to pick own reps

KUCHING, Nov 26 — Sarawak will pick its own delegates to attend the first meeting of the Steering Committee of the review of the Malaysia Agreement 1963 (MA63) next month, Speaker Datuk Amar Asfia Awang Nasar said today.

He said they will replace members of the committee from Sarawak named by de facto Law Minister Datuk Liew Vui Kiong last month.

“I do not know whether he speaks for us. Let us speak for ourselves, so we have decided to disregard members of the committee from Sarawak named by the federal minister,” Asfia told reporters after chairing the state Consultative Committee on MA63.

He said the new members of the Sarawak delegation will be chosen by Chief Minister Datuk Patinggi Abang Johari Openg.

“It is entirely up to him to decide on the number and composition of the delegation,” he said.

The first meeting of the 16-member Steering Committee of MA63 headed by Prime Minister Tun Dr Mahathir Mohamad has been scheduled for December 17 in Putrajaya.

Abang Johari described the Steering Committee as favouring the federal government and was not a reflective of Sarawak as an equal partner to Malaya in the formation of Malaysia.

Last month, Liew named Abang Johari, State Attorney-General Datuk Talat Mahmmod Abdul Rashid and Works Minister Baru Bian as members of the Steering Committee from Sarawak.

The other committee members are Sabah Chief Minister Datuk Seri Mohd Shafie Apdal, Finance Minister Lim Guan Eng, Economic Affairs Minister Datuk Seri Mohamed Azmin Ali, Communication and Multimedia Minister Gobind Singh Deo.

Foreign Minister Datuk Saifuddin Abdullah, Minsiter of International Trade and Industry Datuk Darell Leiking, Transport Minister Anthony Loke Siew Fook, Chief Secretary to the Government Datuk Seri Dr Ismail Bakar, Chief Judge of Sabah and Sarawak Datuk David Wong Dak Wah, Attorney-General Tommy Thomas, Universiti Malaya Law Professor Prof Emeritus Datuk Dr Shad Saleem Faruqi and Sabah Attorney-General Zaleha Rose Pandin.

The Sarawak State Legislative Assembly had on November 6, 2018 unanimously passed a motion to form a Consultative Committee comprising of members of all the political parties from Gabungan Parti Sarawak and Sarawak Pakatan Harapan.

Today, Asfia said it imperative for the steering committee to review the financial provisions of Article 112D and Article 112D(3)of the Federal Constitution pursuant to the recommendations of the Inter-Governmental Committee Report (IGC).

“The restoration of Sarawak’s eroded state rights is meaningless without the review of the financial positions. It is like having an automobile but without battery and gasoline,” he said.

He said within the framework of Malaysia, the state seeks to maximise and expand the common areas of agreement and to minimise and narrow the margin of differences.

“We shall explore areas where we all can agree and areas we agree to disagree. There are issues, for instance, on immigration where we consider as non-negotiable.

“The territory of Sarawak, its territorial integrity land mass, continental shelf, seabed and subsoil are absolutely non-negotiation,” he said.

He added to concede on immigration is to open up the floodgate that would unleash a torrent of immigrants from across the border and those far outside Sarawak to sweep away the state population.

“Sarawak will then cease to exist. This is absolutely, completely and totally unacceptable,” Asfia said.

He said the Sarawak delegation will emphasise on the constitutional responsibilities of the federal government, including those which have been under-performed and where breaches have been committed over the past years that continue into the present and showing no signs of any change.

他说：「我们目前没有检讨分摊旅游税的意愿，目前这项政策将被维持。」

拿督莫哈末马汀可达比在此间为2018年婆罗洲手工艺品节主持开幕后，受询时这么表示。

马希迪建议悉数交州政府

他是针对前州旅游、文化及环境部长拿督马希迪曼俊提出，本州理应获得来自旅游税收100%收入的言论，这么置评。

也是卡拉纳安区州议员的马希迪在最近召开的州议会上，参与辩论明年度州财政预算案时指出，沙巴乃国内第二大赚取旅游收入的州属，理应获得来自旅游税收的全面收入，以便能推行本身的计划，为旅游业锦上添花。

他指出，联邦政府应悉数交回从本州收取的旅游税收。

「毫无疑问，沙巴旅游业正蓬勃发展，但我们对外在因素非常敏感，这些外在因素分分钟会面向我们，我们必须未雨绸缪，而来自旅游的税收，可用作支撑这个工业。」

于去年9月1日落实的旅游税，在接下来3个月内获取近4000万令吉收入，本州是继吉隆坡之后，旅游税第二高赚取的州属，达453万令吉。前者总共贡献了1660万令吉。
