MA63 committee line-up ready, to be submitted to Cabinet on Wednesday

KUCHING: Sarawak will submit the line-up of the Special Cabinet Committee to oversee Malaysia Agreement 1963 (MA63) to the Cabinet on Wednesday.

Minister in the Prime Minister’s Department Datuk Liew Vui Keong said the committee comprised of three levels; steering committee, technical committee and working committee.

The top committee will be chaired by Prime Minister Tun Dr Mahathir Mohamad and sit-in once every two months.

Sarawak Chief Minister Datuk Patinggi Abang Johari Abang Openg and his Sabahan counterpart Datuk Seri Mohd Shafie Apdal as well as some academicians will be in the steering committee.

They will be assisted by Attorney-General Tommy Thomas, Sarawak Attorney-General Datuk Talat Mahmood Abdul Rashid and Sabah Attorney-General Zaleha Rose Pandin.

“The A-G will also co-chair the technical committee with me, involving several ministers and directors of government agencies,” Liew said.

Meanwhile, the working committee will be conducting the preliminary works as well as to look into the works done by the previous government.

“We have completed the line-up and forward to various ministries and hopefully (I can) submit to the Cabinet this Wednesday,” he said.

Speaking at a Press conference after meeting with the state’s legal fraternity at the Sultan Iskandar Building here today, Liew said instead of going back to the historical facts of MA63, it is more practical to focus on its implementation.

“We are focusing directly into the core issues of the matter to identify what we can do to make Sabah and Sarawak as equal partner and to return their rights.

"We don’t want to go back to historical fact as it is a known fact that there was an agreement signed and there’s no dispute about it,” he explained.

Liew also said that the support from the opposition lawmakers are important in order to amend the Federal Constitution, particular Article 1(2), where upon amendment to the article in 1976, Sabah and Sarawak had been “downgraded” from being equal partners of the Federation of Malaysia to being on the same level as other states.

“I will be meeting the opposition MPs to work on an agreement or consensus because we need to have two-third majority before making the amendment,” he said.

“In fact, I have met several Sarawak MPs and the outcome was positive.

"After amending Article 1(2), the rest will fall into place, such as oil royalty, equal distribution and regional development,” he added.

Dr M to chair MA63 committee, law minister confirms

PETALING JAYA, Oct 10 — Prime Minister Tun Dr Mahathir Mohamad will lead the Malaysia Agreement 1963 (MA63) Special Cabinet Committee, which was formed to review and propose measures to rectify the status of Sabah and Sarawak.

De facto law Minister Datuk Liew Vui Keong today announced the line-up of the committee, which consists of eight federal ministers.

They are Liew, Finance Minister Lim Guan Eng, Economic Affairs Minister Datuk Seri Azmin Ali, Communications and Multimedia Minister Gobind Singh Deo, Foreign Minister Datuk Saifuddin Abdullah, Works Minister Baru Bian, International Trade and Industry Minister Darell Leiking and Transport Minister Anthony Loke.

The other members are Sarawak Chief Minister Datuk Abang Johari Openg, Sabah Chief Minister Datuk Seri Mohd Shafie Apdal, Attorney General Tommy Thomas, Chief Secretary to the Government Datuk Seri Ismail Bakar and legal academics, such as Prof Emeritus Datuk Shad Saleem Faruqi.

“There are three levels: The first is the steering committee which has high-powered people in there; the technical committee, that I and the AG will chair and consists of MPs from Sabah and Sarawak and relevant heads of department, and the working committee,” Liew explained.

He added the steering committee will meet in a month’s time, after which it will hold a meeting once a month for the next six months.

“Everything will be discussed, including the oil royalty and other developments,” he told reporters after the “Law Reform Talk” at Universiti Malaya here, today, referring to Sabah and Sarawak’s request to increase the oil royalty from the current 5 per cent.

“We do not want to go back on the historical aspect of the matter because some of the issues may be agreed upon without much dispute. We would like to go to the core of the matter straight away, mainly the implementation of the Malaysia Agreement.”

Liew said the working committee consists of stakeholders and specialists from the legal fraternities as well as those who are deemed instrumental to the MA63.

“Everything is going full gear to ensure the restorations will be completed in six months’ time.

“After six months, the report will be tabled... it could be shortened, but the six months is to look at the best way to implement MA63,” he said.

Sabah and Sarawak have asked that they be recognised as equal partners as Malaya in accordance to the agreement made during the formation of Malaysia.

KUCHING, Oct 10 — Chief Minister Datuk Abang Johari Openg today said he has proposed an expanded committee to be formed to study all aspects of the Federal and State Constitutions and the Malaysia Agreement 1963 (MA63) as a step to restore the status of Sarawak to its original position at the  formation of Malaysia.

He said the committee should not be limited to a Cabinet-type committee consisting of federal and state ministers and legal officials from the federal and state attorney-general chambers.

He said he has expressed the state government’s views that the expanded committee be modelled along the set-up of the Inter-Government Committee (IGC) formed by the Malaya, United Kingdom, Singapore, Sarawak and Sabah before the formation of Malaysia in 1963.

“In this case, members of the expanded committee should also consist of state assemblymen and members of parliament, not just the members of the state and federal Cabinets,” he told reporters after opening the Fourth Borneo Water and Wastewater Exhibition and Conference here.

He said assemblymen and MPs can interact and study the relevant provisions of the Federal and State Constitutions, just like the members of the IGC did prior to the formation of Malaysia.

Abang Johari said he appreciated a proposal to amend Article 1(2) of the Federal Constitution to restore Sarawak’s position as an equal partner to Malaya in the formation of Malaysia.

“I think it is better for us to look at the proposal holistically and in totality because there is also Article 112D that has to be looked into,” he said.

Article 112D of the Federal Constitution refers to reviews of special grants accorded to both Sarawak and Sabah by the federal government.

De facto Law Minister Datuk Liew Vui Keong had said two days ago that he would table a Bill to amend Article 1(2) of the Federal Constitution to restore the status of Sarawak and Sabah in the coming session of Parliament.

He said if the amendment had the support of two-thirds of the total number of MPs, then the two Borneo states would get their status back as defined under Article 4 of MA63.

Article 1(2) of the Federal Constitution was amended in 1976 which downgraded the status of Sarawak and Sabah from being equal partners to Malaya to among the 13 states in Malaysia.

Liew had said he was committed to put 100 per cent effort to fulfill the law reform agenda as well as matters pertaining to Sabah and Sarawak, specifically mentioned in the 4th Core of the Pakatan Harapan Manifesto.

JOHOR BARU: Lack of jobs, difficulties in owning a home and economic downfall – these are the three common problems faced by Johoreans, said Johor Amanah chairman Aminolhuda Hassan.

He also said that many Johoreans had to work in Singapore due to a large pool of foreigners working in their state, and thereby taking their jobs.

Aminolhuda said that Johoreans do not mind working in the 3D – dangerous, difficult and dirty – sectors as the pay was much higher.

“There are mega projects in the state like Refinery and Petrochemical Integrated Development in Pengerang and the Iskandar (Malaysia) region. How many locals are working there?

“And (even if there are), they are mostly blue collared and unskilled workers,” said the Parit Yaani assemblyman in an interview with Berita Daily recently.

Johor Menteri Besar Mohamed Khaled Nordin had addressed the issues during the last day of the state legislative assembly sitting on Monday.

Khaled said that cross border economy was a global trend and not only limited to Johor and Singapore.

On housing problems, Aminolhuda said that the opposition had fought for a higher minimum price for foreigners to buy properties in the state.

He said that now foreigners can only buy properties worth RM1 million and above in the state.

Housing and industrial units in Johor, such as in the Iskandar Malaysia region, are often sought by buyers from Singapore.

“We must be stern on this as most Johoreans, especially the bumiputera at the village, are still living on other peoples’ land.

“In my own constituency, a family is still living on cemetery ground for the past 48 years. How can they build house at other place when they don’t have their own land?,” he asked.

The downfall of Malaysian economy had also further burdened the people, especially those living in Johor Baru, said Aminolhuda.

“The cost of living in JB is higher than other town in the state…even higher than living in Melaka, Negeri Sembilan or Kelantan for that matter,” he said.

Liew said the committee would meet in about a month in Putrjaya the determine the direction on MA63.

Liew, who attended the Law Reform Talk programme at Universiti Malaya here, said among the issues that will be studied regarding MA63 included oil royalty and development in Sabah and Sarawak.

“So, I think this will be very inclusive that will include so many issues very close to the heart and minds of every Sabahan and Sarawakian.

“Generally, we do not want to go back on the historical aspect of the matter because some of the issues may be agreed upon without much dispute ...go to the core of the matter straightway, the implementation of MA63,” he said.

Under the Malaysia Agreement 1963, Sabah, Sarawak and Singapore joined Malaya to form the Federation of Malaysia. Singapore exited the federation in 1965 and Sabah and Sarawak are now claiming that there has been an erosion of their rights as per the agreement and want the situation rectified

Sabah and Sarawak think alike regarding MA63

PETRA JAYA: Sabah and Sarawak are on the same page regarding amendment to the Federal Constitution so as to return rights belonging to the two states stated under Malaysia Agreement 1963 (MA63).

Sabah Chief Minister Datuk Seri Mohd Shafie Apdal said Sabah shared the same stance with Sarawak, and it was high time to look into the agreement.

“Our interests are the same and we need to come together to have the same voice to realise what has been agreed by our forefathers,” he said after a courtesy call to the Sarawak Chief Minister Datuk Patinggi Abang Johari Abang Openg at the State Legislative Assembly complex here.

“It doesn’t mean that we don’t love Malaysia but we need to get back what’s due to us, including 20 per cent oil royalty based on gross profit.

“We don’t mind sharing our wealth (oil and gas resources); that’s why we are not asking for 100 per cent,” he said.

Malaysia, Shafie said, was formed in a peaceful manner through proper discussions and negotiations among Malaya, Sabah and Sarawak.

“So let’s us do it (restore our rights) in the same manner. We will negotiate since there are demands from Sabah and Sarawak - on how to fulfil the demand,” he said, adding that Sabah and Sarawak had to work together as the country was facing financial constraints.

Meanwhile, Abang Johari agreed with his Sabahan counterpart and would work closely with him for the benefit of both states.

Apart from that, he said, Sabah and Sarawak expected to cooperate in various industries, including tourism and industrialisation.

“To support their industry with our electricity supply is among potential areas to look into as we have several hydropower dams which can offer cheaper power supply. We can sell our electricity to Sabah,” he said.

KOTA KINABALU: Sabah rights activist Zainnal Ajamain has poured scorn on Putrajaya’s decision to appoint three committees to study ways of complying with the Malaysia Agreement 1963 (MA63).

Speaking to FMT, he said the effort would be a “big waste of time” because the decision makers had yet to settle the question of whether the Borneo states would be dealing with Malaysia or Malaya.

“The steering committee must first declare whether its members represent Malaya, Sabah and Sarawak or Malaysia, Sabah and Sarawak,” he said.

He was reacting to de facto law minister Liew Vui Keong’s announcement of the line-up of the steering committee. The composition of the other two panels – the working and technical committees – will be announced by the steering committee at a later date.

The steering committee is chaired by the prime minister. Its members are the Sabah and Sarawak chief ministers; the federal, Sabah and Sarawak attorney-generals; the chief secretary to the government; the chief judge of Sabah and Sarawak; a law professor; and eight federal ministers, two of whom hail from Sabah and one from Sarawak.

“When I saw the list,” Zainnal said, “my immediate concern was whether the prime minister represents Malaya or Malaysia.”

If the committee were to declare itself as representing Malaysia, Sabah and Sarawak, then its set-up would be at odds with MA63 since Sabah and Sarawak did not sign the agreement with Malaysia, he said.

If it were to speak of “Malaya” instead of “Malaysia”, he added, it would be declaring that the Federation of Malaya had been masquerading as Malaysia for more than 50 years.

Article 8 of MA63 specifies that any action to implement the agreement must be taken by the governments of Malaya, Sabah and Sarawak.

Zainnal said the committee would not be able to amend MA63 without the involvement of the settlor, which is the British government, since MA63 is an international treaty registered with the United Nations.

He also questioned whether the Sabah and Sarawak chief ministers were in the committee as peers of the prime minister or as his subordinates. If they were there as subordinates, he said, there was a fear that they would support every position taken by the chairman.

Referring to the federal ministers in the committee who are East Malaysians, he said they no longer represented Sabah and Sarawak because they had accepted federal positions.

Consequently, he added, the committee would end up being just another vehicle used by the federal government to avoid giving the people of Sabah and Sarawak their rights, including financial dues.

“What about the billions that constitutionally and rightfully belong to Sabah and Sarawak that the federal government blatantly took using federal and parliamentary power with impunity?

“Pushed to a corner, the steering committee will probably say, ‘The government has no money now. Please ask the previous government.’”

He proposed the establishment of a panel to oversee the steering committee, saying it should be composed of representatives of the governments of Britain, Malaya, Sabah and Sarawak.

“If they fail to do this, then the people of Sabah and Sarawak have no choice but to go to London,” he said.
