HR只是说如果有裁员金会在最后的薪水单出现，如果没有就不会出现

不久前，我代老婆写给MOM问有没有被保护，得到非常不爽的回答:@

Dear Sir/Madam,

I know that I am covered under The Child Development Co-Savings Act.

However I would like to know whether I am covered under Employment Act.

My position is xxxx Coordinator and my monthly salary is S$xxxx.

I am NOT a manager. I DO NOT HAVE any subordinate.

I am also NOT an executive with supervisory functions as explained in MOM website http://www.mom.gov.sg/employment-practices/employment-rights-conditions/employment-act/Pages/default.aspx, i.e. I DO NOT HAVE the authority to influence or make decision on issues such as recruitment, discipline, termination of employment, assessment of performance and reward, or involvement in the formulation of strategies and policies of the enterprise, or the management and running of the business.

I have a Bachelor degree in xxxx only. So I am not a Professional with specialised knowledge/skills likes lawyers, accountants, dentists and doctors as explained in MOM website.

I understand that I am NOT covered by Part IV of the Act as my salary exceed S$2000.

However, am I covered by the other Parts of the Employment Act?

Please confirm asap. Thank you very much.

Dear Madam xxx,

We refer to your email dated xxxx

The Employment Act does not cover any person employed in a managerial or executive position. Managers and executives are employees with executive or supervisory functions. These functions include the authority to influence or make decision on issues such as recruitment, discipline, termination of employment, assessment of performance and reward, or involvement in the formulation of strategies and policies of the enterprise, or the management and running of the business. They also include professionals with tertiary education and specialised knowledge/skills and whose employment terms are comparable to those of managers and executives.

Hence the employee's coverage under the Employment Act would depend on his actual job duties and not based on his title or salary scale.

We are sorry we are unable to state definitively the employee's coverage under the Employment Act as only the Court has jurisdiction on this issue should there be a dispute.




过后我在MOM的MinisterOfState的FB这样写：
MOM said the employee will need to write to MOM and then MOM will investigate, my concern is the employer will know which employee complain to MOM and this will put the employee in an weak position in a company.

MOM also said that it is The Court who decide whether a employee is covered under Employment Act. I wonder why MOM is not publishing guideline or samples cases of who is and who isn`t covered by Employment Act.
A lot of people still thinks that an employee is not covered by Employment act if his/her salary is above S$2k or if he/she has university degree. This is not true. Those with salary above $2k only not covered under Part IV. Other parts of the Act cover them if they are not Manager or Executive. The Act defines who is executive but it is not clear enough to layman, that is why MOM said only The Court can decide whether one is covered, based on the actual job duties, not based on Job Title, Salary or University Degree http://www.mom.gov.sg/empl

感觉不是很好吧？

许多年前我任职的公司倒闭，只给我们最后一批留下来的员工每人一个月的遣散费。那间还是ST旗下的一间小公司，由何晶管理ST的年代。

当时两个孩子才两，三岁，之前已经停薪(补充：是停止加薪，每年只有十三个月的月薪）接近三年，还有房子要供，银行几乎没有储蓄。。。。终于熬过了。

不知道你的情况如何，无论如何请别放弃或轻视自己的信念和能力。

失业期间可以到邻里图书馆打发时间，好好地休息，放慢步伐，好好计划更长远的人生。
其实日复一日的工作，反而使人无法平伏中求变。
在不一样的日子，更能令人有股非一般的启发。。。
